These Terms of Service ("Terms") govern your use of PulseOps Monitor and the website at www.pulsenetics.com, operated by PulseNetics ("we", "us"). By purchasing or using PulseOps Monitor, you agree to these Terms.

1. Licence

When you purchase PulseOps Monitor, we grant you a non-exclusive, non-transferable, perpetual licence to use the software on the number of servers permitted by your licence tier.

2. Update Period

Licence fees include free updates for the following periods:

After the update period expires, your existing version continues to work indefinitely. You may renew your update period at a discounted rate. Renewals are optional — there is no subscription or recurring charge.

3. Trial Licence

The free trial provides full Professional-tier features on up to 5 servers for 30 days. No credit card is required. After 30 days the software stops monitoring until a paid licence is activated. Trial data is not deleted.

4. Payment

Payments are processed by our payment partners (Paddle or Gumroad). All prices are in GBP and exclude VAT where applicable. VAT is calculated and collected by our payment processor at checkout based on your location.

Licences are delivered digitally by email. There are no physical goods.

5. Refund Policy

We offer a 30-day money-back guarantee. If PulseOps Monitor does not work in your environment and we are unable to resolve the issue within 30 days of purchase, contact support@pulsenetics.com for a full refund. No questions asked.

Refunds are not available after 30 days from the purchase date except where required by applicable consumer law.

6. Data and Privacy

PulseOps Monitor is entirely on-premise software. All monitoring data is stored in your own SQL Server database. We do not have access to your monitoring data, your servers or any information about your infrastructure. See our Privacy Policy for details on what personal data we collect.

7. Disclaimer of Warranties

PulseOps Monitor is provided "as is" without warranty of any kind, express or implied. We do not warrant that the software will be error-free, uninterrupted or suitable for any particular purpose.

In particular, PulseOps Monitor is a monitoring and alerting tool. It does not guarantee that all incidents will be detected or that all alerts will be delivered. You should not rely solely on PulseOps Monitor for critical infrastructure decisions.

8. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim arising from your use of PulseOps Monitor shall not exceed the amount you paid for your licence in the 12 months preceding the claim.

We are not liable for any indirect, incidental, consequential or special damages, including loss of data, loss of profits or business interruption, even if we have been advised of the possibility of such damages.

9. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of PulseOps Monitor after changes are posted constitutes acceptance of the updated Terms. We will notify existing customers of material changes by email.
